answering questions about crime and punishment in islam

Without security and stability a human being is not able to properly conduct his daily life.
lets discuss some theses crimes and its punishment :

1-Stoning,  floging
its so sad when anti islam sites talk about this topic they show picture of women whom have been stoned, itd like they just want to say ' look what Muslims do against women!'
lets us read noble ayat of Quraan about 'Flogging':
'2. The woman and the man guilty of illegal sexual intercourse, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allah, if you believe in Allah and the Last Day. And let a party of the believers witness their punishment. (This punishment is for unmarried persons guilty of the above crime but if married persons commit it, the punishment is to stone them to death, according to Allah's Law).' Surat An nur

the bible:'[9] And the daughter of any priest, if she profane herself by playing the whore, she profaneth her father: she shall be burnt with fire.[10] And he that is the high priest among his brethren, upon whose head the anointing oil was poured, and that is consecrated to put on the garments, shall not uncover his head, nor rend his clothes;10] And he that is the high priest among his brethren, upon whose head the anointing oil was poured, and that is consecrated to put on the garments, shall not uncover his head, nor rend his clothes;'Leviticus 21

in Quraan :' 4.And those who accuse chaste women, and produce not four witnesses, flog them with eighty stripes, and reject their testimony forever, they indeed are the Fasiqun (liars, rebellious, disobedient to Allah).
5. Except those who repent thereafter and do righteous deeds, (for such) verily, Allah is Oft-Forgiving, Most Merciful.
6. And for those who accuse their wives, but have no witnesses except themselves, let the testimony of one of them be four testimonies (i.e. testifies four times) by Allah that he is one of those who speak the truth.
7. And the fifth (testimony) (should be) the invoking of the Curse of Allah on him if he be of those who tell a lie (against her).
8. But it shall avert the punishment (of stoning to death) from her, if she bears witness four times by Allah, that he (her husband) is telling a lie.
9. And the fifth (testimony) should be that the Wrath of Allah be upon her if he (her husband) speaks the truth.
10. And had it not been for the Grace of Allah and His Mercy on you (He would have hastened the punishment upon you)! And that Allah is the One Who accepts repentance, the All-Wise.' Surat Anur
'23. Verily, those who accuse chaste women, who never even think of anything touching their chastity and are good believers, are cursed in this life and in the Hereafter, and for them will be a great torment,
24. On the Day when their tongues, their hands, and their legs or feet will bear witness against them as to what they used to do.
25. On that Day Allah will pay them the recompense of their deeds in full, and they will know that Allah, He is the Manifest Truth.'An Nur

Stoning :
in the bible :"If a man is found sleeping with another man's wife, both the man who slept with her and the woman must die. You must purge the evil from Israel" (Deut. 22:22).
"If a man commits adultery with another man's wife both the adulterer and the adulteress must be put to death" (Lev. 20:10).

in Islam :Abdullah b. 'Abbas reported that 'Umar b. Khattab sat on the pulpit of Allah's Messenger (ﷺ) and said:
Verily Allah sent Muhammad (ﷺ) with truth and He sent down the Book upon him, and the verse of stoning was included in what was sent down to him. We recited it, retained it in our memory and understood it. Allah's Messenger (ﷺ) awarded the punishment of stoning to death (to the married adulterer and adulteress) and, after him, we also awarded the punishment of stoning, I am afraid that with the lapse of time, the people (may forget it) and may say: We do not find the punishment of stoning in the Book of Allah( Allah says in Quraan:106. Whatever a Verse (revelation) do We abrogate or cause to be forgotten, We bring a better one or similar to it. Know you not that Allah is able to do all things?), and thus go astray by abandoning this duty prescribed by Allah. Stoning is a duty laid down in Allah's Book for married men and women who commit adultery when proof is established, or it there is pregnancy, or a confession. Sahih Muslim

Sulaiman b. Buraida reported on the authority of his father that Ma, iz b. Malik came to Allah's massenger(may peace be upon him) and said to him: Messenger of Allah, purify me, whereupon he said: Woe be upon you, go back, ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, then came and said: Allah's Messenger, purify me. whereupon Allah's Messenger (may peace be upon him) said: Woe be upon you, go back and ask forgiveness of Allah and turn to Him in repentance. He (the massenger) said that he went back not far, when he came and said: Allah's Messenger, purify me. Allah's massenger(may peace be upon him) said as he had said before. When it was the fourth time, Allah's Messenger (may, peace be upon him) said: From what am I to purify you? He said: From adultery, Allah's Messenger (may peace be upon him) asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah's Messenger (may peace be upon him) said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been (divided) into two groups about him (Ma'iz). One of them said: He has been undone for his sins had encompassed him, whereas another said: There is no repentance more excellent than the repentance of Ma'iz, for he came to Allah's massenger(may peace be upon him) and placing his hand in his (in the Holy Prophet's) hand said: Kill me with stones. (This controversy about Ma'iz) remained for two or three days. Then came Allah's Messenger (may peace be upon him) to them (his Companions) as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Ma'iz b. Malik. They said: May Allah forgive Ma'iz b. Malik. Thereupon Allah's Messenger (may peace be upon him) said: He (Ma'iz) has made such a repentance that if that were to be divided among a people, it would have been enough for all of them. He (the narrator) said: Then a woman of Ghamid, a branch of Azd, came to him and said: Messenger of of Allah, purify me, whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Ma'iz. b. Malik. He (the noble, Prophet) said: What has happened to you? She said that she had become pregnant as a result of fornication. He (the Holy Prophet) said: Is it you (who has done that)? She said: Yes. He (the Holy Prophet) said to her: (You will not be punished) until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered (of the child). He (that Ansari) came to Allah's massenger(may peace be upon him) and said the woman of Ghamid has given birth to a child. He (the Prophet) said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah's Apostle, let the responsibility of his suckling be upon me. She was then stoned to death.'Sahih Muslim
notes : islam is not religion that exposes Muslim's faults, its not a religion that tell you go and and bring three men with you and try to expose this sinner woman, or this sinner man, no no .the hadith you have just read it shows how the noble prophet asked the man and the woman to ask forgiveness from Allah.

The Prophet (sallallaahu alaihi wa-sallam) said, what translated means, "Allah will bring the believer closer to Him, and will shield him form being exposed (for his evil deeds in front of everyone). He will say: "Do you remember such and such (evil) deed? Do you remember such and such (evil) deed?' He will say: "Yes, O my Lord!' When He gets his confessions for his evil deeds, and he (the salve) thinks that he is close to destruction, he will say: "I have preserved you (from being exposed in front of others for these evil deeds) during your lifetime. Today, I forgive them for you.' Then, he will be given his record of deeds. As for the disbelievers and the hypocrites, they will be called in public: "These are the ones who lied on their Lord (did not follow His Guidance sent down with their Prophets). Therefore, Allah's curse will befall the unjust ones." [Saheeh al-Bukharee and Saheeh Muslim]

Abu Umama reported:

We were sitting in the mosque in the company of Allah's Messenger (ﷺ). A person came there and said: Allah's Messenger, I have committed an offence which deserves the imposition of hadd upon me, so impose it upon me. Allah's Messenger (ﷺ) kept silent. He repeated it and said: Allah's Messenger, I have committed an offence which deserves the imposition of hadd upon me, so impose it upon me. He (the Holy Prophet) kept silent, and it was at this time that Iqama was pronounced for prayer (and the prayer was observed). And when Allah's Apostle (ﷺ) had concluded the payer that person followed Allah's Messenger (ﷺ). Abu Umama said: I too followed Allah's Messenger (ﷺ) after he had concluded the prayer, so that I should know what answer he would give to that person. That person remained attached to Allah's Messenger (ﷺ) and said: Allah's Messenger, I have committed an offence which deserves imposition of hadd upon me, so impose it upon me. Abu Umama reported that Allah's Messenger (ﷺ) said to him: Didn't you see that as you got out of the house, you performed ablution perfectly well. He said: Allah's Messenger, of course. I did it. He again said to him: Then you observed prayer along with us. He said: Allah's Messenger, yes, it is so. Thereupon Allah's Messenger (ﷺ) said to him: Verily, Allah has exempted you from the imposition of hadd, or he said. From your sin.Sahih Muslim

Everyone from my nation will be pardoned except those who sin in public. Among them is a man who commits an evil deed in the night which Allah has covered for him, then in the morning he says: O people, I have done this sin. His Lord had covered him during the night but in the morning he unveils what Allah has covered. Sahih Bukhar

2-Apostasy

Dr Bilal Philips ( ex christian) :“Apostacy encourages the rejection of law and order in society. One who personally abandons the faith and leaves the country would not be hunted down and assassinated. The death penalty discourages those who might think to join the religion in order to undermine it from within. Western Civilization executes its citizens for giving away state secrets something material. Islaamic law prescribes the death penalty for something far more serious. Rebellion against God is a far greater crime than rebellion against state secrets.”
Hebrews Chapter 10 '28He that despised Moses' law died without mercy under two or three witnesses:
29 Of how much sorer punishment, suppose ye, shall he be thought worthy, who hath trodden under foot the Son of God, and hath counted the blood of the covenant, wherewith he was sanctified, an unholy thing, and hath done despite unto the Spirit of grace?
'
'2 If there be found among you, within any of thy gates which the LORD thy God giveth thee, man or woman, that hath wrought wickedness in the sight of the LORD thy God, in transgressing his covenant,3 And hath gone and served other gods, and worshipped them, either the sun, or moon, or any of the host of heaven, which I have not commanded;4 And it be told thee, and thou hast heard of it, and enquired diligently, and, behold, it be true, and the thing certain, that such abomination is wrought in Israel:5 Then shalt thou bring forth that man or that woman, which have committed that wicked thing, unto thy gates, even that man or that woman, and shalt stone them with stones, till they die.6 At the mouth of two witnesses, or three witnesses, shall he that is worthy of death be put to death; but at the mouth of one witness he shall not be put to death.
7 The hands of the witnesses shall be first upon him to put him to death, and afterward the hands of all the people. So thou shalt put the evil away from among you.'Deuteronomy Chapter 17
the Prophet (peace and blessings of Allaah be upon him) said: “Whoever changes his religion, execute him.” Narrated by al-Bukhaari, 6524.

brother Bassam Zawadi :'There seems to be a problem with many "modernist and liberal" Muslims out there who would like to "sugarcoat" the religion of Islam by distorting what it really teaches. There are those that go at length to deny that Islam teaches that apostates must be killed. They either deny the explicit hadith that speak about this or reinterpret it to only refer to those apostates that would fight the Muslims.'
notes 1-there are  rules and conditions behind killing apostates E,g : the apostate must be interrogated first in order to refute what doubts he has for three days, etc.
2-when I speak about apostates that must be killed I am only referring to those apostates who live under an Islamic theocratic state and have openly declared their apostasy. What this means is that no Muslim has a right to go to America or Europe for example and start killing ex-Muslims, for he has no such authority to do so.

however, apostasy is defined as a Muslim making a statement or performing an action that takes him out of the fold of Islam.  The punishment prescribed for it in the Sunnah is execution, and it came as a remedy for a problem that existed at the time of the Prophet, may the mercy and blessings of God be upon him.  This problem was that a group of people would publicly enter into Islam together then leave Islam together in order to cause doubt and uncertainty in the hearts of the believers.  The Quran relates this event to us:
“A group from the People of the Scripture said: ‘Believe in what is revealed to those who believe at the beginning of the day, then disbelieve at the end of the day, so perhaps they might return from faith.” (Quran 3:72)
the  apostasy could not be used as a means of causing doubt in Islam.
At the same time, the apostate is given time to repent, so if he has a misconception or is in doubt about something, then his cause of doubt can be removed and the truth clarified to him.  He is encouraged to repent for three days.
Bassam Zawadi :'Now since non-Muslims don't "like" or agree with the law of killing of the apostate they would argue that Muslims should be "open minded" and allow people to freely choose whatever religion they please. They would argue back that religion is only between God and the person. It is no body else's business.
Muslims could easily reply back by saying:
- You non-Muslims say that people should be free to practice their religion. Our religion states that apostates must be killed. So allow us to "freely practice our religion". If you don't allow us to, you are contradicting your selves then.
- Muslims would hate it if apostates were allowed to be free to run around publicly displaying their apostasy and see their loved ones getting affected by it. Why should Muslims suffer by standing back and watching this all happen? Why do non-Muslims insist that they don't get affected while Muslims must? These are double standards.
-You say that "religion is only between God and the person", fine so if someone apostatizes let him keep it between God and himself in private and not publicly display it. If he chooses to go public with it and start affecting others, then he hasn't made his religion only between himself and God but involved others as well. If he involved others as well, then others (i.e. the Islamic state) have the right to intervene.Non-Muslims would also argue back that the apostate's intention is sincere. He is not intentionally trying to lure people into hell. They would say that we must take his intentions into account.

First of all, Muslims do take his intentions into account and this is precisely why we won't go ahead and have the apostate killed immediately. The authorities will bring the apostate in for questioning and ask him to lay out all the doubts that he has regarding Islam. Muslim scholars will be appointed to answer his questions. If he is not convinced and it appears to the scholars that his reasons for leaving are not valid (usually they are not valid, most people leave Islam for emotional reasons) they would then have him executed.

Secondly, it is not an excuse for us to let an apostate go free doing what he pleases just because his "intentions are sincere". At the end of the day, this is affecting the people around him and he must be stopped.

Millions of people around the world don't believe that marijuana should be made illegal. They believe that it is a natural plant and "gift from God" as singer Carlos Santana said.

Their intentions are sincere, but just because their intentions are sincere that doesn't mean that we legalize marijuana. That doesn't mean that we just stand by and let them get away with their crime. They are made aware of the punishment of breaking the law and should be held accountable regardless of what their intentions are. If they don't agree with the law, that is too bad. They have to deal with it.
The same applies to the apostate. He must obey the law. Him not agreeing with or liking the law means absolutely nothing.
Should we implement the law to please God and displease the apostate or should we remove the law to displease God and please the apostate? It is definitely not the latter.'

85. Everyone shall taste death. And only on the Day of Resurrection shall you be paid your wages in full. And whoever is removed away from the Fire (hell) and admitted to Paradise, he indeed is successful. The life of this world is only the enjoyment of deception (a deceiving thing).' quraan, meanin

We are not alone. There is something out there bigger than ourselves. Where will you go after you die? What do you believe and why do you believe it? What is the point of having a mind if you never change it? Here's a surprisingly unsurprising statistic: Everyone dies sooner or later; there is no escaping it and you will be dead for longer than you are alive. This suggests that eternity might be worth more than a passing thought.

Are you ready for the inevitable? There is no need to be fearful of that inevitable moment, so long as you are prepared and as long as you are not taking comfort in something that sounds nice but is really just positive but wishful thinking. Make your life journey count, consider your eternal destination. Just believing in a lie wont make it truth, no matter how much you want it or how appealing that lie is. It is better to know the truth than to live in the delusion of a lie. No one likes being deceived, but in a world of political correctness, acceptance and anything goes, it is easy to side-step the truth of reality. What REALLY is true?

Can we just make up our own truth and say "well that is true for you, but my truth is something else"? Surely we can't all be right, especially when there are so many contradictory beliefs and top world religions out there.
